Issue:

This is a Chieftaincy matter which started in the Okiti pupa Division of the High Court of Ondo State in suit No. HOK/7/84. The plaintiffs who are the respondents/cross-appellants here in their further Amended Statement of Claims claimed against all the defendants now appellants/cross respondents and the respondents/cross respondents herein:- "(i) Declaration that the Registered Declaration of Ugbo Chieftaincy are defective and in exhaustive of the custom and tradition of the Ugbo chieftaincy and therefore null and void amongst others. The trial court after taking evidence and heard the parties, dismissed the plaintiffs' case in its entirety. The plaintiffs' appeal to the Court of Appeal was allowed on a single issue. The Court of Appeal also ordered a retrial in the suit. The plaintiffs have further appealed to the Supreme Court.
